Tenement Management Scheme in practice
The Tenement Management Scheme in the Tenements (Scotland) Act 2004 applies where the title deeds do not provide otherwise. It defines 'scheme property', which normally includes the roof, external walls and foundations, and sets out how owners make decisions: one vote per flat and a majority of all votes.
Costs for scheme property are normally shared equally, unless the largest flat is more than one and a half times the size of the smallest, when they are shared by floor area. Title deeds often set their own rules, which take priority.
